Gating Order 2021
Section 129 Highways Act 1980

Notice is hereby given that the 天美传媒 (鈥渢he Council鈥) in exercise of its powers under S. 129 A (1) of the 1980 Highways Act (鈥渢he Act鈥) and all other existing powers being satisfied that the conditions set out in Section 129 A (3) have been met. Namely that the premises adjoining or adjacent to the highway are affected by:

Reasoning

  • There are premises that adjoin or are adjacent to the highway to which the Order relates that are affected by crime or anti-social behaviour and.
  • That the existence of that highway is facilitating the persistent commission of criminal offences or anti-social behaviour and.
  • That it is in all the circumstances fitting to make this Order for the purposes of reducing crime or anti-social behaviour.

Anti-social behaviour means behaviour by a person which causes or is likely to cause harassment, alarm or distress to one or more other persons not of the same household as himself (Clean Neighbourhoods and Environment Act 2005).

Effects

This statement relates to the making of a gating order to suspend rights of access to use that part of the highway by introducing a gating order on Cwmtillery Access Road northbound to the Welsh Water Pump Station, between the hours of 21.00 hrs until 07.00hrs. See accompanying attached plan for the location of the gate.

If you wish to object to the proposals you will need to send the grounds for objection in writing to the Head of Community Services, so as to be received by 7th October 2021. Any objection received after that date will not be considered.
